Genesis CEO Elaine Bernard to Remain in Jail

Fresno, CA Bernard appeared in court wearing a jumpsuit and shackles. Wednesday's appearance was for a 2007 DUI charge. The CEO of Genesis Family Center was convicted last year of stealing from the nonprofit. As part of her probation, the judge ordered Bernard not to attend social events. But last week, investigators saw the magazine "Imagine Fresno" A photograph shows Bernard attending a February art reception.

Carol Dela Torre is Elaine's sister. Dela Torre said, "She was at an event that was youth related. It was on Genesis property." Dela Torre was also convicted of stealing from Genesis. Dela Torre says Elaine abided by her probation even though she attended the reception, "She was home before her curfew which was at 7 o'clock. In fact, I was at the event as well and she left by 6 o'clock."

Dela Torre says the DA's office is harassing her family. Prosecutor Mike Elder says they are treating Elaine like any other convicted felon. Elder said, "They believe she has attended several social events which if they were social events ... even Genesis related social events ... would be a violation of probation."

Elaine also attended a Saint Patrick's Day party at a North Fresno office building. Thursday morning, a judge will consider Elaine's future now that she's accused of violating her probation.
