Lawsuit Over Upscale Parlier Neighborhood

Fresno, CA Andres Torres gets worried with more and more cracks forming on his stucco walls. Torres moved in two years ago to what he thought was his dream home. Within a few months, Torres said cracks spread from his ceiling to his tiled floors. Torres said in Spanish the problems are growing. He joined 52 other neighbors who filed a lawsuit against the builders of Bella Vista Estates.

Construction started four years ago at the corner of Fig and Fourth. At the time, Bella Vista Estates was billed as the most exclusive residential project in Parlier. The builder said he has not seen this lawsuit. But he said he tried hard to build good quality homes.

Fresno based Lambeth Construction is listed as one builder of Bella Vista. The company's president declined an interview. Red Lambeth said he built 120 homes on the site and, "All the homes have warranties. I have never received a complaint of any kind. I spent a lot of money to make sure I complied with every code and legal requirement."

David Avila-Rodriguez also complained of defective work, but he is not yet part of the lawsuit. He pointed to cracks around his garage and rafters unconnected to the roof. Avila-Rodriguez said, "I got robbed. I thought I was buying a new house, but I bought a pile of (beep)."

Both homeowners said they just want the builder to follow through on promises of constructing top quality homes.
