It's an unusual case. Harry baker a former political leader and the owner of the Sierra Telephone Company may have been the victim of a blackmail scheme in the Fresno case. But, the Attorney for the girl said he still committed a crime.
Las Vegas Police confirmed Baker is a suspect in a sexual molestation case there.
Bill Cassell, Las Vegas Metro Police said: "He is the suspect in this case. The facts in this case point to the charged of lewdness with a minor under 14."
Charges have not been filed in the Las Vegas case.
Baker's Attorney, Rick Berman held a news conference on Monday to say the incident was part of an elaborate blackmail scheme in which a hidden camera was used. Berman says the video shows a naked girl entering the motel room with an adult woman, who encouraged baker to touch the girl.
Rick Berman, Baker's Attorney said: "The legal requirements for sexual touching for illegal sexual touching did not occur and I've seen the film."
Berman says Baker paid the girl's family, who he described as "gypsies" a quarter of a million dollars to avoid public embarrassment. But an attorney appointed by the court to represent the girl, who's now 15 says the video shows a crime was committed.
Charles Oren, Attorney for girl said: "He groped her. He was in the room with her and touched her in various place and he shouldn't have done that. And the law is real clear. You keep your hands off a 13 year old girl and he knew better."
The girl is currently living in foster care.
Baker was arrested Monday, but posted bail and was released from jail.
Las Vegas Police said they are waiting for their District Attorney to decide if there is enough evidence to file charges against Harry Baker in their case.
