Effort to Block Sale of E-Cigarettes Fails

Fresno, CA State Attorney General Jerry Brown took one e-cigarette company to court, claiming the devices contain dangerous chemicals and are being marketed to children.

Action News first told you about the controversy in a special report back in November.

E-cigarettes operate with a battery-operated heating element and emit a nicotine-laced mist instead of smoke.

The F.D.A. also wanted to regulate the e-cigarettes as drugs. But a federal judge denied that request, effectively allowing laws written for cigarettes, to also apply to the electronic kind.
