45-year-old /*Liborio Martinez*/ was taken into custody at his home Friday morning.
Authorities searched his home on Avenue 322 outside Visalia, where they found 130 marijuana plants, forty plants more than his prescription.
Deputies say the plants could have produced 130 pounds of pot, worth $500 thousand.
Martinez was also charged with violating Tulare County's outdoor pot growing ordinance.
It's unknown whether the excess marijuana was being sold.
