Lawyers for Fresno County don't want to have a Fresno County jury decide whether the county is responsible for the murder of a 10-year-old boy.

FRESNO, Calif. (KFSN) -- Lawyers for Fresno County don't want to have a Fresno County jury decide whether the county is responsible for the murder of a 10-year-old boy. The county filed a motion to change venues for a retrial of the case centering on the death of Seth Ireland.

The boy's father sued the county, claiming CPS ignored several signs of trouble and left Ireland with his mother in an abusive situation.

In December 2008, his mother's boyfriend murdered Ireland.

Five years later, a jury came down with an $8.5 million dollar verdict against Fresno County.

An appeals court threw out the verdict and the retrial should be coming up soon.
