FRESNO, Calif. (KFSN) -- The Fresno County District Attorney's office said they filed one count of murder against Gage Hurtado. He is accused of killing one-year-old Julius Lopez. He is scheduled to be arraigned in court Monday morning

Julius would have turned two years old next month. He was there at the time of the tragedy, and an autopsy on the child revealed the boy died from blunt force trauma.

Hurtado is the boyfriend of Julius' mother and is now facing a felony charge of assault by means to likely cause death to a child.

Authorities were called to the apartment on the 2500 block of 9th street Wednesday morning regarding the child's injuries but their attempts to revive the boy were unsuccessful.

Hurtado tried to avoid our camera, but couldn't avoid getting arrested and booked into the Fresno County Jail Wednesday night. Hurtado has a long history of domestic violence that dates back to at least September of 2011.

Just two weeks ago Hurtado was taken into custody while deputies were at the Calwa home performing a welfare check and discovered there was a warrant out for his arrest.
