A North Valley man accused of killing a 17-year-old Delhi teen with his car will not face felony charges because attorneys say they cannot prove he's guilty.

Micheal Lindo, 33, was arrested last Tuesday after police say he killed Jennifer Arroyo. He was facing murder, hit and run, and DUI charges for the deadly crash.

Court reports say the suspect told officers he was driving along August Avenue when he heard a loud noise that caused him to believe he had hit a dog.

Lindo later returned to the scene. Officers claimed he could not do certain field sobriety tests, however, his blood alcohol content level was below the legal limit.

"This suspect was not under the influence above the .08. In fact, he wasn't even close. As far as a hit and run charge, although he continued driving, he turned right back around and went back to the scene and in fact called 911 within moments," Merced County Chief Deputy District Attorney Harold Nutt said.

Lindo does have several prior DUI charges, and was on probation at the time of the incident. Attorneys say they are filing misdemeanor charges, and filing a violation for his probation.
