FRESNO, Calif. (KFSN) -- Former Madera County supervisor Harry Baker will head to trial on charges of lewd acts with a 13-year-old girl.

A jury decided Baker is competent to stand trial. The case goes all the way back to 2007.

Several doctors said his mental health is slipping quickly. But jurors agreed with two other doctors who say Baker seems to have selective memory.

Defense Attorney Roger Nuttall said, "The fact of the matter is he's an elderly, frail, older man with memory issues, health issues."

Baker will remain in custody. He's been in the Fresno County jail for about three months after missing several of his court hearings and doctor appointments.

Baker faces up to eight years in prison if he's convicted.
