Surge of ADA lawsuits in Fresno
Some small business owners said they were victims of ADA lawsuit abuse.

FRESNO, Calif. (KFSN) -- The Americans with Disabilities Act (ADA) was enacted to ensure equal access for the disabled. But some small business owners said they were victims of ADA lawsuit abuse. Many didn't know where to turn. They said they're victims of what they call frivolous lawsuits.

Dozens of mini-marts in Fresno have been hit by Americans with Disabilities Act lawsuits.

The owner of Handi-Stop improved signage and the parking area but also paid $25,000 to settle a suit. Andy Chikara of Fresno explained, "When they get hit the first thing they don't have extra money. The first thing they do they fire one of their employees."

Asian Village on Kings Canyon Blvd. also faced an ADA lawsuit. One store was found with inventory boxes in an aisle. The parking lot had to be repaved. New ramps and signs were put in.

Bobby Vang wore a shirt showing he paid $210,000 to settle his case. Vang said, "I do believe the law began with a lot of merit. It's those attorneys and their clients that take advantage of the loopholes in this law."

Citizens Against Lawsuit Abuse mapped 180 Fresno businesses sued in the last two years.

Julie Griffiths was disturbed to see which businesses are targeted. Griffiths said, "It's the businesses that service our lower income citizens. Many of the businesses and I would estimate about 80 percent are minority and immigrant owned businesses."

Business owners gathered at the Fresno Chamber of Commerce to share their concerns.

Lee Ky spoke up for her mother. She said, "I'm not asking for special treatment." She asked for a provision to the law - one which offers a grace period before businesses are nailed with a fine which starts at $4,000.

In the meantime businesses are urged to get a certified audit to make sure they are ADA compliant.
