Suspect accused of killing Fresno woman in Fresno bar takes stand in own defense

FRESNO, Calif. (KFSN) -- The suspect accused of killing a Fresno woman and seriously injuring her husband in a Fresno bar, took the stand Tuesday in his own defense.

On the stand, Craig Foster confessed to pulling out a nine millimeter gun inside the Crossroads Bar and firing it. Only he says he pulled out his weapon after Herman Tatum pulled out a glock .45.

The prosecutor asked Foster, "You saw the gun in Herman's hand before you even went for yours, is that right?"

Foster responded, "Yes."

Prosecutor then asked, "Was he pointing it at you before you even reached?"

Foster answered, "He was coming up and pointing it, yes."

The man who is accused of trying to make a pass at Janee Tatum and getting shutdown by both her and her husband, said everything was fine until Herman started shouting and getting aggressive.

For the first time ever, Foster claims Herman fired one round. But, not one other witness, including any law enforcement officer, has backed up his statement.

"Is it your testimony that Herman fired a shot, one or more shots at you? Is that your testimony," asked the prosecutor.

Foster answered, "He shot one that I know of."

Foster said he didn't know the Tatum's before that night. He also told jurors he didn't remember several details. However, he did recall leaving the bar, taking a train to Cleveland, Ohio and hiding the gun in a bathroom garbage can.

Janee died after she was shot in the head. Herman was shot twice, but lived to tell his story Monday-- a very different version from the man on trial who could spend the rest of his life in prison if convicted.
