Teen and mom taking steps towards lawsuit against Fresno County Sheriff's Office after traffic stop

FRESNO, Calif. (KFSN) -- A teenager and his parents are taking steps toward a lawsuit after a traffic stop in April. The teen said he was injured while being detained all during a driver's training session.

Dominic Elliott was behind the wheel on Blackstone and Bullard when he first spotted the deputy in his rear view mirror.

"I can see that he is typing in the license plate number."

Dominic said the driving instructor next to him said to not worry. What the 16-year-old didn't know was the car he was learning to drive in, had a license plate that was reported lost or stolen.

"They get out of the car with all their guns loaded. Pointed at me and started yelling throw the key out the window, so I threw the key out the window."

The Fresno High junior who plays second base on the school's baseball team is also a straight "A" student. Dominic claims he was roughed up during the detainment.

"He aggressively grabbed my arm, my right arm aggressively and yanked it and up and down and I heard my wrist pop."

After deputies sorted out the situation, Dominic returned home. His mother listened to the story stunned and immediately went to the driving school. Sophia Elliott paid $295 for the spring break driver's training sessions and had one goal in mind.

"My son to learn to drive and get a good experience out of this and it didn't turn out that way."

The Elliotts have now hired an attorney who filed a tort claim, in preparation for a lawsuit.

"They could have approached the car. They should have asked him for identification. His instructor was hollering at them, he's a student, he's a student, he's a student. There's no need to arrest him. The car is registered to Drive America," said Mark Coleman, Elliott's attorney.

Medical records reveal Dominic sprained his wrist and appears to have nerve damage.

Drive America did not return calls for comment. The school will be listed in the lawsuit as well.

Officials from the Sheriff's Office also declined to make a statement because the investigation is ongoing and involves a personnel matter.
