Kirby was allegedly a passenger on the boat that struck Dallen McEntire on Shaver Lake back in September of 2006.
The boy survived, but suffered brain damage, and he's blind in one eye.
Kirby and Roger Guzman are accused of being on the boat and leaving the scene after the accident. Kirby is still charged with being accessory and a passenger who failed to report the crime.
