Charges Dropped in Boating Hit-n-Run

Some of the charges have been dismissed against one of the men charged in a hit-and-run boating accident at Shaver Lake.The judge in the case dismissed two charges against Thomas Kirby saying there wasn't enough evidence.

Kirby was allegedly a passenger on the boat that struck Dallen McEntire on Shaver Lake back in September of 2006.

The boy survived, but suffered brain damage, and he's blind in one eye.

Kirby and Roger Guzman are accused of being on the boat and leaving the scene after the accident. Kirby is still charged with being accessory and a passenger who failed to report the crime.
