Facebook and work trash talk

The issue began when an employee at a non-profit in Buffalo, New York, complained about a co-worker on Facebook. Several other employees chimed in, criticizing working conditions and staffing issues. When the company got wind of the conversation, it fired five employees on the grounds that they were harassing one of their co-workers.

But a judge ruled that the employees were within their rights to converse among themselves about working conditions. Under the National Labor Relations Act, employees have the right to talk with each other about improving work conditions.

The employees not only got their jobs back, but they will also receive back pay.
