Jorge Banda murder trial faces another delay

Tulare County Sheriff's Detective /*Kent Haws*/ was shot and killed while on a call in Ivanhoe back in 2007.

/*Jorge Banda*/ was in court Wednesday. Attorneys set a new trial date for Banda in August 2012. This is the fifth delay in setting Banda's trial.

Attorneys say the case has been difficult and endured many hearings, including one for Banda's mental capacity. In 2008, a jury found Banda did not have the mental capacity to be eligible for the death penalty.

Banda's attorney was just recently replaced, due to health reasons so his new attorney will have a lot to catch up on.

David Alavezos, prosecutor said, "While we have not asked for any continuances we understand the case is not going to be tried until next summer."

Bill Wittman, Tulare County Sheriff said, "We all knew him real well he was a good friend to everybody and we want to see this come to conclusion."

Jorge Banda's next court date will be in June 2012 for more pretrial hearings.
