The crash happened just after 1:30 on West North /*Bear Creek*/ Drive, near Brookside in Merced.
Police say /*Luron Rushing*/, 37, was driving under the influence when he lost control of his car and crashed into Bear Creek.
Rushing was able to get out of the car and swim to safety, but his passenger, who is not being identified, died in the crash. Two pitt bulls were also killed.
Police say Rushing was driving on a suspended license. His license was suspended because of a prior DUI arrest in September.
