Tomato growers in a legal battle with the FDA

The lawsuit seeks about $40-million in losses stemming from a case in 2008. That's when the Food and Drug Administration mistakenly blamed tomatoes for a salmonella outbreak. The outbreak turned out to be linked to hot peppers from Mexico

Now, growers in seven states want the government to reimburse them for the business they lost because of the wrong warning.
