Deandre Jean-Pierre now facing 4 misdemeanor counts for crimes last year

But the prosecutor told jurors this is yet another story that's not believable. Instead, he asked them to remember the victim's accounts.

"One by one they got up there. They took that stand," said David Zimmerman, Deputy District Attorney They did not waiver, they did not change their answers- because the truth does not change."

But defense attorney Franz Criego said the victims made their observations and identifications within a few seconds and provided different suspect descriptions.

"Either five foot eight or you're not. Five foot six or you're not," said Creigo. "Or five foot five or you're not. You either have an afro or you don't."

Initially, Jean-Pierre faced five counts of sexual battery. But, one was dropped after a victim refused to testify Wednesday.

A picture posted on social media continued to take center stage Thursday. Jean-Pierre claimed he was in Sacramento with friends October 23. The same evening two women were attacked within less than an hour by Fresno State.

Prosecutors say there is no way to prove when the photo was taken and at what time.
