Closing arguments begin in rare murder trial involving two defendants and two sets of jurors

FRESNO, Calif. (KFSN) -- Jurors listened to evidence against Gustavo Duenas Wednesday afternoon--one of two men accused of an attempted robbery that left two men dead, including his own father.

Duenas is accused of working with Jorge Rodriguez to commit robberies on a December night back in 2014, with text messages to help prove the plan.

A prosecutor says Calvin Reese was the target of a robbery and it is what a witness saw and heard that he says is critical to this case.

"Sees a thin young Hispanic male go up to the body he sees him lean over he's doing something at the body, that's looking for a wallet, which Calvin coincidentally didn't even have. He got killed for his wallet didn't even have it on him," said prosecutor.

The senseless crime also caused Duenas' father to get shot in the midst of it.

According to the prosecution, Duenas did not want his father to get killed and in an interview with law enforcement, Duenas admits Rodriguez' role.

POLICE DETECTIVE: Was it Jorge or not?

DUENAS: Yeah

A physical description of the suspects by a witness also helps prove he was not the one to fire shots but shows he was part of the robbery scheme that left Reese and his father Jose killed by gunfire.

A witness also heard this question after Reese was killed 'Did you get him?'

"Did you get him? Gustavo Duenas is the one who made that statement to Jorge Rodriguez as Jorge Rodriguez is up at the body of Calvin Reese that is lying shot and dying in the street," said prosecutor.

The prosecutor says the two men were also seen running from the scene together by a witness, backing up his belief that they acted together in this crime.
