The County of Tulare District Attorney's Office is asking the Dinuba Police Department to complete its murder investigation.

At this time, no criminal charges have been filed against the four suspects previously arrested and held by officers.
The DA's office added that it has asked for additional findings from the Dinuba Police Department but has not yet received them.
"Police departments may make an arrest based on probable cause. However, to file a criminal case for prosecution, the available evidence must establish guilt beyond a reasonable doubt," Stuart Anderson with the County of Tulare District Attorney's Office said in a statement.
Around 3 am on November 6th, police went to Sergio's home on Roosevelt Way for a welfare check and found him shot multiple times.
They believe it was a burglary.
That same day a teenager was arrested but was released.
A week later, two men, ages 20 and 19, as well as a 21-year-old woman were also taken into custody.
The woman and 20-year-old man were released shortly after but the 19-year-old wasn't let go until Thursday.

All four were set free due to insufficient evidence.
For Martin's family, these last two weeks have been agonizing and heartbreaking.
"We have to believe that this is not where it's gonna end. We're gonna continue to hope, be hopeful that there's an arrest made and conviction because this is not just going to go unsolved for us," said Sergio's cousin, Wendy Gonzalez.
Dinuba Police say their investigators have been working tirelessly since the murder, serving multiple search warrants, collecting evidence, and impounding a vehicle.
There are pieces of evidence still waiting to be processed.
"A lot of the things that we don't have control over are the crime lab stuff. The crime lab is not the city or the county, it's the state so a lot of the things that we have to file over, we can ask for things to be expedited, but we still have to stand in line," explained Dinuba Police Chief Abel Iriarte. "We believe we have arrested all the suspects involved but we could be wrong so any tip from the public we will take but we are pretty sure we have all the suspects we are looking for."

As for Martin's family, they say they are thankful for the love and support they have received from the community.
"We are gonna trust the process. And we're gonna wait. We're gonna have patience, I guess, is what we need to do. But there will be justice for this," expressed Gonzalez.
