Fresno liquor store clerks seeks mental health diversion as mother grieves daughter's death

"She would have been 20 this year," Dalia Martinez told Action News.

Lily was a passenger in a small car when it crashed near Hoover High School.

Investigators believe the young driver was under the influence after buying alcohol from University Deli Liquor and say Hassan Mian was the clerk that night.

"No parent should have to bury their child because of the actions of someone who was supposed to be trained," Martinez said. "You check IDs and you double check the pictures (to ensure) it matches, and if they're underage, you say no."



Mian is out on bail after pleading not guilty to four misdemeanors, including three counts of selling alcohol to a minor.

"The clerk is fighting his charges by trying to get them dismissed under a diversion program," Martinez said.

Lily's family has been through this before. Just last year, Action News was there as Mian pushed for a different diversion program.

The judge rejected it and sent the case to trial. But in January, Mian began seeking a mental health diversion.

"I feel it's inappropriate in this case because he didn't just do this one time. He did it three times," Martinez said about Mian's alleged crimes. "To claim mental health doesn't seem right to me."



Action News could not record Mian in court following objections from defense attorney Robert Troncoso.

Troncoso did not respond to a request for comment.

"It just seems like he's jumping around trying to get out of it," Martinez said about the clerk.

The judge delayed Friday's hearing by more than a month, setting it for the end of October when she could decide whether the case would end with diversion or head to trial, where Mian could face up to six months in jail if convicted.

"It doesn't matter how long it takes. As long as I can get justice for her," Martinez said. "Everybody needs to be held accountable."
