PORTERVILLE, Calif. (KFSN) -- A judge denied the motion to dismiss a murder charge against the Porterville mother accused of leaving her children in a hot car.

Bakersfield Police say back in June, Maya Hernandez left her children, ages one and two, locked in her vehicle for two-and-a-half hours.

Prosecutors allege the 20-year-old left the boys alone while getting a cosmetic procedure.

One-year old Amillio Gutierrez died, but his two-year-old brother survived.

Hernandez is scheduled to appear in court on August 29 for a hearing. Her trial is scheduled to start on September 8.
