Mistrial declared against mother accused of leaving son in hot car during cosmetic procedure

KERN COUNTY, Calif. (KFSN) -- A mistrial has been declared for the murder charge a Porterville mom was facing for the death of her son, who was left in a hot car for hours while she got a cosmetic procedure.

According to our sister station KERO in Bakersfield, 20-year-old Maya Hernandez was found guilty on two counts of child endangerment, but a jury could not decide on the second-degree murder and involuntary manslaughter charges.

Prosecutors accused Hernandez of leaving her two young sons, one-year-old Amillio Gutierrez and his two-year-old brother, strapped in their car seats outside a med spa on June 29.

Amillio died after being hospitalized with a body temperature of 107 degrees. His older brother survived.



Hernandez's defense attorneys argued that prosecutors failed to prove she showed a conscious disregard for life.
