Supreme Court reaffirms birthright citizenship, rules on transgender athletes

FRESNO, Calif. (KFSN) -- On the final day of its term, the Supreme Court ruled on birthright citizenship Tuesday, dealing a blow to President Trump.

In a 6-3 decision, the justices reaffirmed that babies born on American soil are automatically American citizens. "It's the broadest interpretation. It's the one, the outcome that we have been hoping for," Fresno immigration attorney George Rios told Action News.

Rios called the ruling "very clear."

"If you were born here, you are a U.S. citizen; that is your right, given to you by the Constitution, and nobody can take that away unless they amend the Constitution," he said.

The decision comes amid President Trump's immigration crackdown, with enforcement operations happening across the country, including in Fresno.



The court has limited the president's power. "It gives, again, a little bit of a collective sigh of relief that the Constitution is still the Constitution," Rios said.

The court also ruled Tuesday on transgender athletes, deciding 6-3 that states can ban them from participating in girls' and women's sports.

"This ruling really says that, sure, a state may discriminate, not that they must discriminate," said Sasha Buchert, an attorney for trans student-athletes during a national press conference.

In California, there is no such ban, and the state protects trans athletes.

The issue remains a hot topic, though, with members of the public and local officials weighing in.



"I want to see women and girls protected from boys or men dressed as women, being in their locker rooms, or competing against them in sport," Bredefeld told Action News on Tuesday.

For two years, student AB Hernandez has won state championships for field events in Clovis, competing as a female and drawing protesters.

AB's mother posted on Instagram after the Supreme Court ruling, writing that her daughter "...is worthy of living a life filled with dignity, joy, and opportunity."
