Schuster has been in a Los Angeles County jail for the past two and a half months as she faced her trial. She returned to Fresno County Tuesday morning.
Jail officials tell us she is being treated like all other inmates while she awaits her sentencing. Schuster's fate is now in the hands of a Fresno County judge.
She faces life in prison for the July 2003 murder of her husband Tim Schuster. Investigators found his body in a barrel of acid.
Schuster's defense attorney said he will soon ask for a new trial.
ABC 30 Legal Analyst Tony Capozzi said the defense must dig up concrete information to force a new trial of the former Clovis chemist.
"What the defense will do is go through what happened during the trial and see if there were any evidentiary errors, jury misconduct; any possible problems that would have had an effect on the outcome of the case," says Capozzi.
Schuster will find out her punishment nearly 11 months after a judge sentenced James Fagone. A jury convicted Fagone for helping in the murder.
At his sentencing, Ralaine Fagone gave an emotional farewell to her son.
Action News has learned she will attend Schuster's sentencing and will make a statement to a woman she has called a liar.
"I think it would be very emotional, a very difficult sentencing process but I think the sentence is going to be very clear in this case; life without the possibility of parole," says Capozzi.
James Fagone is facing life in prison without the possibility of parole.
Schuster has not filed an appeal yet. Her defense attorney plans to stay with the case all the way through the appeals process.
