The defense for Jorge Banda made the claim to a Tulare County Judge this morning.
The judge agreed to a request to suspend charges until Banda can be evaluated by a doctor.
Authorities claim Banda shot and killed Tulare County Sheriff's Detective Kent Haws last December.
Banda and his attorney will return to court at a later date.
