LOS ANGELES -- The family of a student who was killed in a crash between a school bus and FedEx truck in Northern California is filing a lawsuit.

The lawsuit alleges potential design and performance failures in the bus the students were riding in. The firm handling the case also claims the FedEx truck had defects.

Ismael Jimenez, 18, was one of 10 people killed in April as he headed to Humboldt State University for a college tour. He was a senior at Inglewood Amino Charter High School.

A FedEx spokeswoman declined to discuss the litigation, but said in a statement: "Our heartfelt condolences remain with everyone touched by this tragic accident. We remain focused on providing support to those affected and cooperating with the authorities as they conduct their investigation."

Another family member of a student who died in the crash also filed a lawsuit in late-April. Rosa Rivera, the mother of Jennifer Bonilla, claimed FedEx trucks have history of catching fire and did not have adequate doors.
