Antonio Salas is accused of killing Pablo and Jose Mendez in June 2009 and gave up his right to a preliminary hearing.
A jury convicted his brother, Benito, of the murders last summer, but jurors couldn't reach a unanimous decision on whether Antonio was also guilty.
Witnesses say they saw Antonio Salas pull the trigger, but when the brothers faced murder charges together, Benito took the blame. He got a life sentence.
Antonio is expected to have his second trial later this year.
