$1.25 million settlement reached in death of Donovan Maldonado
The city of Fresno and Loren Lebeau have settled the lawsuits filed by the Maldonado family for the fatal accident that occurred on Shepherd Avenue in July of 2012.

FRESNO, Calif. (KFSN) -- Donovan Maldonado was only 7-years-old when he was hit by a drunk driver and dragged the length of two football fields. The boy was crossing a Northeast Fresno road in 2012 with his family when he was killed. His 18-month old sister and father were also hit and suffered serious injuries.



"It's not an easy settlement for anyone and it's a tragic loss it's a terrible case," said attorney Warren Paboojian.



Finally two years later, the family is agreeing to settle lawsuits they filed with the city of Fresno and the convicted drunk driver. The city will pay $1.15 million dollars to the Maldonado family for the poorly lit and constructed cross walk. It's since been converted into an underpass for safe crossing.



"I think the city reached a fair agreement. I think the family, this way they avoid a trial in six or seven months and they can move on," said Paboojian.



Former central high varsity boys basketball coach Loren LeBeau is now serving a 12-year-prison sentence. He left the scene after dragging the boy but went back shortly after. He'll pay his insurance policy limits of $100,000 dollars and combined the family will receive a total of $1.25 million dollars. Restitution for a life that can never be replaced.



"People from all walks of life have been very supportive and done some wonderful things for the family and wanted me to make sure to tell everyone that they're very thankful for everyone during this difficult time," said Paboojian.



Action news reached out to city leaders who say they can't comment on pending litigation.



The center should be finished in five to seven months. Paboojian says the family does appreciate the gesture from the city to celebrate Donovan Maldanado's memory.
