The Fresno district attorney's office claims Thomas Wiley attempted to kill Martin Rodriguez outside their Central Fresno apartments back on September second of last year.

An argument between the two men resulted in a shot being fired through Rodriguez' neck. He was left paralyzed from the neck down. The bullet also hit Rodriguez's dog inside the apartment.

We weren't allowed to show his face in court as he explained the incident to the jury.

Shooting victim, Martin Rodriguez said, "He brought it up towards me and i was like you've got to be kidding me. I slapped it to the side and he just brought it back up and raised it up to my neck and fired."

The dog Bessie recovered from her injuries two days after being shot. The trial continues Tuesday at the Fresno County courthouse.
