A Deal in the Genesis Group Home Case

6/18/2008 Fresno, CA Elaine Bernard and Carol Dela Torre accepted a plea deal Wednesday. The deal also means they won't be sentenced to state prison.

Bernard and Dela Torre left the court house today without speaking to the media. They were facing a retrial, accused of stealing thousands of dollars from Genesis Group Homes. That's an organization the two sisters founded.

Bernard plead no contest to 2 felonies on Wednesday; grand theft and tax evasion and agreed to pay $100,000 dollars in restitution. She is currently the C.E.O. Her attorney said Bernard is expected to resign.

Her sister, Dela Torre, plead no contest to a misdemeanor grand theft. While the judge indicated he will not sentenced them to state prison, he has the option to send them both to the county jail.

The judge will hand down the sentencing in August. With this plea deal, the sisters agreed to give up their appellate rights.
