A judge had declared a mistrial in the DUI trial of former Fresno State football player Jason Shirley. The jurors said they could not agree on a verdict in the case.

Shirley is accused of driving drunk, and slamming his car into an apartment complex last October. His defense team claimed Shirley suffered a concussion and only appeared to be drunk.

In April, Shirley was drafted by the NFL's Cincinnati Bengals.
